General conditions of sale


Preamble
The site is owned by K-WHEELS in its entirety, as well as all related rights. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. However, hypertext links to the site are allowed without specific requests.

1. Acceptance of conditions


The customer acknowledges having read, at the time of placing the order, the special conditions of sale stated on this screen and expressly declares to accept them without reservation.
These general conditions of sale govern the contractual relations between K-WHEELS and his client, both parties accepting them without reservation. These general conditions of sale shall prevail over all other conditions contained in any other document, unless prior, express and written waiver.


2. Products


The photographs illustrating the products do not enter the contractual field. If errors are introduced, in any case, the responsibility of K-WHEELS can not be engaged. The majority of the products offered to its customers by K-WHEELS are available in our warehouse.

AVAILABILITY:

2.1. Product and price offers are valid as long as they are visible on the site, within the limits of available stocks.

2.2. In case of unavailability of product after placing the order, the customer will be refunded the price of the product if his bank account has been debited, and within thirty days of the effective date of payment.


3. Order


The order can only be registered on the site if the user has clearly identified by his username and password which are strictly personal.

Automatic registration systems are considered as proof of the nature, content and date of the order. K-WHEELS confirms the acceptance of his order to the customer to the email address he has communicated. The sale will not be concluded until the confirmation of the order after validation of the payment. K-WHEELS reserves the right to cancel any order from a customer with whom there is a dispute over the payment of a previous order. In some cases, including erroneous address, payment default or any other problem related to the order, K-WHEELS, reserves the right to block the order, until the problem is solved. The information given by the buyer, when taking the order engage it: in case of error in the wording of the addressee's details, the seller can not be held responsible for the impossibility in which it could be to deliver the product.

Exceptionally, it may happen that a product is no longer available. K-WHEELS informs you as soon as possible and refunds the item not available.

If the received product has a manufacturing defect or a fault, please follow the procedure below:
1. The customer will have to contact K-WHEELS to give the date of the product recovery that will be done through our transport agency.
2. Once received at the deposit, K-WHEELS check the condition of the product before making the change.
3. If the product is really in bad shape, K-WHEELS will make the change and will cover all the shipping costs, but will not cover the costs of the material used to send the product.
4. Any time, if the product received is in perfect condition, the customer will bear the cost of recovery (12.95 € HT) and the return of the material.

Steps to follow for a return request:
1. Fill in the After Sales Service form.
2. Once the form has been received, our After Sales Department will review your particular case and then keep you informed.
3. If the return is accepted, the Customer Service will indicate the date of recovery. The product must be in perfect condition, properly packaged in the original packaging and attach the return form. Product recovery will be done by K-WHEELS after certification of the entire package and its contents.
4. It will take 7 business days for an exchange or 14 days for a full refund depending on the request, after receipt of the goods.


GUARANTEE

All products K-WHEELS benefit from a warranty period of 2 years from the date of receipt, which covers the possible defects product, and any other deficiencies noted during this period. We recommend the customer to check his parcel at the reception, in the presence of the deliveryman. If at the time of the receipt of the goods by the carrier, the customer notices a missing accessory or damage in the packaging, it will have to indicate it on the delivery order of the carrier, and communicates it immediately to K-WHEELS according to the procedure mentioned above. If it is necessary to repair a product, the customer can directly manage its impact by contacting K-WHEELS according to the procedure mentioned above. If the product is received at our warehouse with damage due to improper packaging, or poor protection, the warranty will not cover the repair. The customer must use the packaging and the original protections. If these protections are not available, a strong cardboard box must be used to return the product.

To report after sales service, please follow these steps:
1. Send an e-mail to contact@kwheels.fr with photographs showing the damage of the equipment, the condition of the packaging and the labels of the agency, so that all the damages, bumps and breaks caused during the transport can be noticed by our After-sales service.
2. K-WHEELS will take care of the after-sales service and will keep the customer informed at all times of the situation.

To claim a product not received the customer will have a delay of 24 HOURS from the date of receipt provided, through our form "Customer Service". In case the product received does not correspond to the customer's order, K-WHEELS will be responsible for the costs of taking back the product and its new shipment.


4. Delivery


K-WHEELS undertakes to deliver to its carrier, all the references ordered by the buyer (within the limits of the available stocks) and this, within the time indicated during the validation of the basket. This carrier engages him by contract with K-WHEELS to deliver the order to the address of the buyer provided by K-WHEELS or deposit it at the Post Office nearest this address in case of absence of the recipient.

In addition for deliveries outside metropolitan France the customer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and all other taxes due under the laws of the country of receipt of the order.

All orders placed at K-WHEELS are intended for the personal use of the customers, the customers or the recipients of the products are prohibited any partial or total resale of the products. K-WHEELS disclaims any legal liability if the payment of taxes was not made by the customer.

In case of apparent defects, the buyer has the right of return under the conditions provided in this document.

Are considered as force majeure releasing the seller from his obligation to deliver, war, riot, fire, strikes, accidents and the impossibility of being supplied. The goods always travel at the risk of the recipient. Always check your parcel on arrival. You have 72 hours to make any reservations with the carrier in case of missing or damaged. Delivery charges are indicated in the basket including your selection. For metropolitan France they are offered from 00 € of purchase and totally free for deliveries in relay point.

For reasons of availability, an order can be delivered in several times to the customer. The customer only pays for one delivery. If the customer wants 2 places of delivery, he will place 2 orders, with related shipping costs.


5. Retraction


You have 14 days from receipt of the articles to make an opinion. In case of request for exchange or refund, you can return the item (s) nine (s) in its (their) packaging (s) of origin, intact (s), accompanied by all any accessories, at the following address:

In case of exercise of the right of retraction, K-WHEELS is responsible for the reimbursement of the sums paid by the customer, free of charge, with the exception of the return costs. The refund is due within a maximum of 30 days.

Any item returned damaged, incomplete, damaged or soiled by the customer will not be returned or exchanged. Please refer to the exchange / return conditions of the site for more information on this subject.


6. Price


The price is expressed in euros. The price indicated on the product sheets does not include transport.
The price indicated in the confirmation of order is the definitive price, expressed all taxes included and including the VAT for France and the countries of the European Union. This price includes the price of the products, the costs of handling, packaging and conservation of the products, transport and commissioning costs. Prices can not be changed once the order has been validated. The price charged to the customer is the price indicated on the order confirmation sent by K-WHEELS. The price of the products is payable in cash on the day of the order.


7. Payment


Payment by credit card: The online payment is made by credit card bearing the initials CB, MASTER CARD, VISA. Online payment e-Transactions allows you to pay via a bank server CREDIT AGRICULTURAL BANK in a secure environment, the data of your payment is sent encrypted and secure thanks to the protocol SSL 3 (Secure Socket Layer) on the Internet.

Your credit card number is therefore directed directly to the servers of the bank CREDIT AGRICOLE, without passing through the server of the shop, guarantee all the more important that your numbers are known only to our banking partner.

The order validated by the customer will be considered effective only when the payment centers concerned will have given their agreement. In case of refusal of said centers, the order will be automatically canceled and the customer notified by email. By the way, K-WHEELS reserves the right to refuse any order from a customer with whom there is a dispute. To know if the payment by cb is refused by your banking establishment your order will be automatically canceled.

2.1 - PAYMENT

Orders are payable in cash on the day of the order.

Payment is made:
- By credit card bearing one of the following acronyms: CB, Visa, Mastercard. The order will not be considered accepted by K-WHEELS only when the banking centers concerned, have given their agreement and that K-WHEELS will have validated the order with respect to its risk acceptance criteria in collaboration with the control company. In case of acceptance of the file by the payment center and by K-WHEELS, the customer will be informed by sending the confirmation of the order by email. In case of refusal of the file, the order will be automatically refused and the customer will also be informed by email.

2.2 - FRAUD CONTROL

The company K-WHEELS, in collaboration with (FIA-NET), controls all orders that have been validated on its site. These controls are designed to protect abusive practices operated by fraudsters.

For an order with a shipping address different from the billing address, K-WHEELS reserves the right to contact the two persons mentioned (person mentioned at the billing address as well as the one mentioned at the delivery address).

As part of these procedures, K-WHEELS or any person authorized by it, also reserves the right to ask the Customer for the necessary documents to execute the order: proof of address, a copy of the ID and a copy of the credit card used for the purchase by hiding all the figures except the last 4. 8. Litigation


This contract is subject to French law. K-WHEELS can not be held responsible for damages of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the products sold. The same is true for any modifications of the products resulting from the manufacturers. The responsibility of K-WHEELS will, in any case, be limited to the amount of the order and can not be blamed for simple errors or omissions that may have persisted despite all the precautions taken in the presentation of products In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution either:

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in the one who takes the trouble to expose his situations. In case of dispute, the customer will first contact the company to obtain an amicable solution. It is recalled that the search for the amicable solution does not interrupt the "short delay" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the discretion of the Courts, the respect of the provisions of this contract relating to the contractual guarantee supposes that the buyer honors his financial commitments towards the seller.

9. Warranty


In any case K-WHEELS can not be held responsible for non-compliance with the regulations and laws in force in the country of receipt, the responsibility of K-WHEELS is systematically limited to the value of the product in question, value at its date of sale and without recourse to the brand or company producing the product.

In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). Provided that the buyer proves the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the civil code); if the buyer goes to court, he must do so in a "short time" from the discovery of the hidden defect (art.1648 of the Civil Code). 10. Legal information


The information of the personal information collected for the purposes of the distance selling is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and guarantee contracts. The lack of information leads to the non-validation of the order.
